By using the Application you acknowledge that you have read and agree to what follows.

1. Nature of the Application

Ainonymity Calorie Counter (the “Application”) is published by AInonymity Inc. (“Ainonymity”, “we”, “us”, “our”). It is a personal tool for tracking estimated daily caloric (or kilojoule) and macronutrient intake, provided for general informational and personal organizational purposes only, and it is not a regulated health product or medical device. These Terms govern your use of the Application, its estimates and its data. Your license to the Application itself is granted under Apple's Licensed Application End User License Agreement, which also applies and prevails over these Terms as to that license.

2. Not Medical Advice

THE APPLICATION IS NOT INTENDED TO CONSTITUTE, AND SHALL NOT BE CONSTRUED AS, MEDICAL ADVICE, DIAGNOSIS, TREATMENT, OR ANY OTHER FORM OF PROFESSIONAL HEALTHCARE GUIDANCE. Nothing contained in this Application should be interpreted as a substitute for consultation with a qualified physician, registered dietitian, nutritionist, or any other licensed healthcare professional. Users with medical conditions, dietary restrictions, eating disorders, or other health concerns are strongly advised to seek qualified professional medical advice before making any changes to their diet or nutritional habits. Do not disregard or delay seeking professional medical advice on the basis of information provided by this Application.

3. Who the Estimates Are For

The caloric (or kilojoule) and macronutrient figures in this Application are derived from equations and reference ranges published for HEALTHY ADULTS, and they are estimates rather than measurements. THIS APPLICATION IS NOT INTENDED FOR PERSONS UNDER 18 YEARS OF AGE; the calculator declines to produce a target for them, because the equation it uses was derived from adults and the requirements of children and adolescents differ and are a matter for a pediatric clinician. IT IS LIKEWISE NOT INTENDED FOR USE DURING PREGNANCY OR BREASTFEEDING, where energy and nutrient requirements are higher and an intake deficit may be contraindicated; those requirements should be determined by a qualified healthcare professional. Where a physician, registered dietitian or other licensed professional has set an intake target, THAT TARGET SUPERSEDES ANY FIGURE SUGGESTED BY THIS APPLICATION.

4. Artificial Intelligence and Data Accuracy

This Application incorporates artificial intelligence (“AI”) technology to assist in estimating caloric (or kilojoule) and macronutrient values. Where a meal is read from a photograph, the accuracy of that reading has not been measured, so treat every figure it produces as an estimate — the amount is the field to correct when a portion looks wrong, in grams or a volume unit where the food offers one. ARTIFICIAL INTELLIGENCE SYSTEMS ARE INHERENTLY IMPERFECT AND MAY PRODUCE INACCURATE, INCOMPLETE, OR ERRONEOUS RESULTS. Caloric (or kilojoule) and nutritional data generated or suggested by the AI component of this Application should be independently verified against authoritative sources, including but not limited to recognized nutritional databases or the guidance of a qualified nutrition professional, prior to any reliance thereon. We make no representations or warranties, express or implied, as to the accuracy, completeness, reliability, currentness, or fitness for a particular purpose of any AI-generated nutritional data.

5. Food Composition Data

Nutrition data is drawn from published government food composition tables and, for packaged products, from manufacturer-submitted values in USDA FoodData Central. Composition varies with season, batch, growing conditions and preparation. These figures are averages and should be treated as such.

6. Credits and Purchases

Some features of the Application are metered by credits, which may be bought through Apple's in-app purchase system. Apple, not AInonymity Inc., is the seller or merchant of record for those purchases depending on your region, and REFUND REQUESTS ARE HANDLED BY APPLE under the App Store terms that applied to your purchase. Credits purchased through in-app purchase do not expire. Features that do not consume credits remain available at no charge.

7. No Warranty

THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. We do not warrant that the Application will be error-free, uninterrupted, or free of viruses or other harmful components. NOTHING IN THIS SECTION EXCLUDES, RESTRICTS OR MODIFIES ANY GUARANTEE, RIGHT OR REMEDY YOU HAVE UNDER THE AUSTRALIAN CONSUMER LAW, THE NEW ZEALAND CONSUMER GUARANTEES ACT, OR THE CONSUMER LAW OF THE UNITED KINGDOM OR THE EUROPEAN UNION, OR UNDER ANY OTHER LAW THAT CANNOT LAWFULLY BE EXCLUDED.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AInonymity Inc. SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APPLICATION, INCLUDING BUT NOT LIMITED TO ANY LOSS, INJURY, OR HARM RESULTING FROM RELIANCE ON NUTRITIONAL DATA, CALORIC (OR KILOJOULE) ESTIMATES, OR AI-GENERATED CONTENT, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THIS SECTION EXCLUDES, RESTRICTS OR MODIFIES ANY GUARANTEE, RIGHT OR REMEDY YOU HAVE UNDER THE AUSTRALIAN CONSUMER LAW, THE NEW ZEALAND CONSUMER GUARANTEES ACT, OR THE CONSUMER LAW OF THE UNITED KINGDOM OR THE EUROPEAN UNION, OR UNDER ANY OTHER LAW THAT CANNOT LAWFULLY BE EXCLUDED, AND NOTHING LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD.

9. User Responsibility

Users assume full and sole responsibility for all decisions made in reliance upon information provided by this Application. Individual caloric (or kilojoule) needs and nutritional requirements vary substantially based on numerous personal factors including, without limitation, age, sex, weight, height, body composition, activity level, metabolic rate, and underlying medical conditions. No generalised caloric (or kilojoule) or nutritional estimate generated by this Application can substitute for personalised professional assessment.

10. Acceptance
